StoryDonkey Terms of Use

Agreement
These Terms of Use are an agreement between you and Savages By Design governing your use of StoryDonkey, including the app, website, and related services. By using StoryDonkey, you agree to these Terms. If you do not agree, do not use the service.
The service
StoryDonkey is an authoring tool intended to help users develop ideas into stories through structured planning, characters, scenes, continuity, revision, and related workflows. Features may change, be added, or be removed. We do not promise that every described or planned feature will be available.
Your content and responsibility
- You retain your rights in content you create or submit, subject to the rights of others and any separate terms that apply to a third-party service.
- You are responsible for the content you submit, the instructions you give, and the outputs you choose to use, publish, or share.
- You represent that you have the rights, permissions, and authority needed to submit your content and authorize its processing by the service.
- Do not submit confidential, unlawful, infringing, or sensitive information unless you understand and accept the relevant risks.
Copyright, originality, and generated content
StoryDonkey and any connected tools may produce suggestions, text, or other outputs that are similar to existing works, contain errors, or are not eligible for copyright protection. We do not guarantee that any output is original, non-infringing, protectable, or suitable for publication.
You are solely responsible for reviewing outputs and for determining whether your use, publication, distribution, or commercialization of any content complies with copyright, trademark, publicity, privacy, defamation, and other applicable laws.
To the maximum extent permitted by law, Savages By Design is not liable for claims, losses, damages, costs, or expenses arising from or relating to copyright infringement, alleged infringement, plagiarism, similarity, ownership, authorship, or the use or publication of content created, uploaded, transformed, or generated through StoryDonkey. This does not remove rights or remedies that cannot lawfully be excluded.
Acceptable use
You may not use StoryDonkey to violate law or another person’s rights; submit malware or abusive content; impersonate others; interfere with the service; bypass access controls; reverse engineer the service except where law permits; or use automated methods to abuse, scrape, or overload it.
No professional advice
StoryDonkey provides software and creative-development assistance, not legal, financial, medical, mental-health, publishing, or professional advice. Verify important information independently and consult a qualified professional when appropriate.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STORYDONKEY IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, ACCURATE, OR AVAILABLE AT ANY PARTICULAR TIME.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SAVAGES BY DESIGN WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL, OR REVENUE, ARISING FROM YOUR USE OF OR INABILITY TO USE STORYDONKEY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF OR RELATING TO STORYDONKEY WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US FOR THE SERVICE DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR USD $100.
Indemnification
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Savages By Design and its officers, employees, contractors, and service providers from claims, liabilities, damages, losses, and expenses arising from your content, your use of StoryDonkey, your violation of these Terms, or your violation of another person’s rights.
Suspension, termination, and changes
We may suspend or terminate access if you violate these Terms, create risk, abuse the service, or if we discontinue the service. We may update these Terms by posting a revised version at this URL. Continued use after the effective date means you accept the revised Terms.
Apple App Store terms
If you obtain StoryDonkey through Apple’s App Store, your use is also subject to Apple’s Licensed Application End User License Agreement and applicable App Store terms. Apple is not responsible for StoryDonkey, its maintenance, support, warranties, or claims relating to it. To the extent permitted by law, Apple is a third-party beneficiary of these Terms and may enforce them against you.
Any subscription or in-app purchase is processed through Apple. Apple controls billing, renewals, cancellation, and refund processing. Manage subscriptions through your Apple account settings and direct refund requests to Apple. Pricing, duration, trial eligibility, and renewal details will be shown before purchase.
Governing law and contact
These Terms are governed by the laws applicable to Savages By Design, without regard to conflict-of-law rules, except where applicable law provides otherwise. Contact: savagesbydesignhq@gmail.com
